Small Claims Courts and How They Work

By Chuck Lunsford So youve decided to go down to the courthouse and go to the Small Claims Division. What now you ask. Lets take a look at the how and why regarding small claims courts. How did they come about and why are they used so extensively. The first small claims court was created in Cleveland in 1913. Within a few years every state had such a court of limited jurisdiction. Small claims courts are attractive for consumers who want to collect a small debt or recover damages for a faulty product or for shoddy service. However, small claims courts are used heavily by businesses and public utilities that want to collect payments from customers for unpaid bills. In a single court session, a department store, utility company, or hospital may obtain judgments against a long list of debtors, making the process very economical. We do not need an attorney to represent us. When you do go to courtroom, you will perhaps be surprised to see this group of people, wearing official badges and sitting in the jury box. Relax; you didnt accidentally stumble into some major hearing about to take place. Read on. These folks are called mediators. They have been handpicked by the court and are highly qualified to act on most cases. They have years of knowledge and experience that effectively works for both parties. When the clerk of the court calls your name and the name of the other party, you will both stand up. When the clerk of the court recognizes both parties are present, he or she will hand a mediator your file at which point your little group goes off into a private room. The mediators do not get to see the file beforehand. The mediator looks at the file, read the statement of claim and asks if there is any conciliatory manner in which the problem can be solved, short of a trial before a judge. During the discussion that follows both parties soon realize the additional costs, time and chances of losing might be. The mediators efforts are to settle this out of court. If there is no chance for settlement, you are then instructed to go back into the courtroom and wait for the judge.Its unlikely you will have a trial that day. The clerk of the court has to schedule it for another day. Sometimes the judge will hear trials that day but you have no idea at what time. If you do decide to stick around that make sure you are ready when your name is called. If you or the other party is not present then the absent party loses by default. The Guide to Changing Your Name after Marriage

By Rachel Greenberg Whether or not to change your name after marriage is a personal decision that each person must make on his/her own. But onceyouve decided to take the plunge, you need to be prepared forthe administrative tasks that await you. Trying to get all of your IDs and accounts updated can be tedious, and even just knowing where to start is a major task itself. The following checklist should make this process much less worrisome, and hopefully hassle-free: 1. Certified copy of marriage license Before you begin, make sure you get 2 or 3 certified copies of your marriage license from the office where you applied for the license. You will need to show this document several times as proof of your name change. You really only need one copy - since most places only need to see the copy, not keep it but its best to have afew extras on hand. 2. Drivers License The Department of Motor Vehicles is run differently in each state, but it is most likely that you will need to go in person to the local office and show a certified copy of your marriage license. Some states will also have you update your name on your voter registration at the same time that you change your name on your license. If they do not, then make sure you contact the appropriate state office to get this done. 3. Social Security Card This will also require a visit in person, so locate the Social Security Office in your area. They will need to see a certified copy of your marriage license, as well as another ID with your new name. If you have already completed step #2, then you will have the necessary ID. The Social Security Administration will notify the IRS and the Post Office of your name change, so you do not need to inform these organizations separately. 4. Bank Accounts & 401k Most banking institutions will need to see a copy of the marriage license (just a regular copy, not a certified copy) along with a written letter stating that you wish to change your name on your accounts. You can either check your accounts online or call each place to see exactly what is needed. Once you have made the change, make sure to order checks with the new name. 5. Passport You will need to mail in a certified copy of your marriage license along with an application to the appropriate passport center. You can obtain copies of this application from your local post office. If you are not renewing the passport (name change only), there should be no charge. You will get the same passport back, with a stamp in the back with your new name. If you are also renewing the passport, then there will be a fee, but you will get a new passport with your new name on it. 6. Local government offices In addition to notifying the state and federal governments (which you have done in steps #2 and #3), you should call your local town or county office to notify them of your name change. Since their systems do not always get data from the regional and national systems, it is best to make sure you have everything covered. 7. Employer Be sure to tell your employer of your name change, since it is important that your benefits and taxes are reported properly. Some employers will change the name with no documentation, but others will need to see the certified copy of the marriage license. 8. Business documents If you own your own business (like I do), then you need to make sure that all business documents and correspondence gets updated with your new name. This includes business bank accounts, credit cards, letterheads, email addresses, etc. 9. Bills and other statements With most utilities, like cable, electricity, phone, etc., you can either change your name online with no documentation required, or make a quick phone call to the customer service department. If you feel like this list is a bit overwhelming, then just make sure you get through the first three steps. They require the most time investment, so get them out of the way first. By Linnea Sheldon Many of us have a hard time recognizing when a relationship isn’t working. It’s so easy to see the signs of the relationship going sour after the fact. Many of us have had the feeling that maybe he isn’t as into the relationship as we are, and this makes us question whether or not he wants to end it. There are several signs that he may be having doubts. The first is when he no longer makes an effort to spend time with you. If he becomes too busy for all the things the two of you used to do together there is a good chance he is thinking about ending it. If he stops answering your phone calls and doesnt return your messages as frequently as usual this may also be another sign. You may start to notice little changes too. He may take a little longer to say those three words after you say them. He might stop wanting to be intimate and say that he is tired or use some other excuse. If he suddenly decides that Thursday nights should be spent with the boys rather than with you and your ritual movie and Chinese takeout something is probably up. Other signs that something is wrong may come from you rather than him. If you feel overly jealous or self-conscious around him this may be because things in the relationship arent right. Also, if you find yourself working harder than usual to look good for him this may be a sign that you are trying to hold onto something. Sometimes there is nothing you can do to mend a relationship once it gets to the point that one or both of you do not want to be in it. A talk is necessary, dont just let things keep progressing. Sit down and have a real heart to heart, but dont make it a chore. Also remember begging and pleading will not change what he feels in his heart. If he stays with you out of guilt this is only going to hurt you more in the long run. Another thing to remember is not to be paranoid. Use your own judgment, if you feel that something is wrong then it is time to approach him about it. If you cant bring the subject up then you probably do not have an open, healthy relationship to begin with. Dont dig for things that signal he may be thinking of breaking up with you. Only worry if you see drastic changes over a period of time. We all get moody here and there, just because he wants to be alone one evening doesnt mean he doesnt care about you anymore. By Rosanna Cooper The recent case of Fairbrother v Abbey National plc [2007], concerned an employee who was employed as a customer manager since March 1998. The employee suffered from Obsessive Compulsive Disorder (OCD), a fact which at the time when she applied for the job was not made known to the employer, but which became clear after she took up her position. For the initial period of her employment, she had a good relationship with her colleagues. However, this changed in 2002 when two of her co-workers began to treat her and another employee, R, less favourably. From then on she was subjected to taunts concerning her OCD and low-level behaviour which was principally designed to upset her condition. R was taunted about her perceived low work-rate, and both R and the employee were ostracised. The situation deteriorated to the point where the two offending colleagues only communicated with the employee by e-mail, despite them all being in the same office. Following a particularly stressful week, the employee walked out on 25th July 2003. She informed the area manager, N, about the problems which had led to her leaving, and he began to investigate the complaint. The two colleagues accepted that they had behaved in an inappropriate manner towards the employee during that week, and then both apologised to N. This outcome of the investigation was passed on to the employee, and she was advised that she should arrange to have a cup of tea with her two colleagues to try to resolve their differences. She was also told she could have faced a disciplinary hearing for walking out on the 25th. On 13 August, she wrote a letter to N outlining the events which led to her walking out, but the letter made no reference to her OCD. Following a meeting with a member of the employers human resources department, F, it was decided that a full investigation of the events occurring in the week of the 21st July 2003 should be undertaken. A month after that meeting, the employee asked to have the events prior that week investigated as well. This second request was denied by the employer. A grievance meeting was then held to discuss the employees allegations that she had been bullied at work and that N had not conducted the initial investigation properly. These complaints were dismissed, which led to the employee to appeal against this decision. An investigation was then carried out of all the complaints that made by the employee and, on 9 February 2004, all her complaints were dismissed. Subsequently, on 7July 2004, she resigned on the grounds that her employer had failed to bring her grievances to a reasonable conclusion. The employee then brought a claim before the employment tribunal for unfair dismissal in that she had been discriminated against due to her condition. The tribunal held that she had been unfairly dismissed due to the fact that the employers lengthy grievance procedure had a number of serious flaws which meant that the employer had behaved in a way which irreparably damaged the relationship of mutual trust and confidence between it and the employee. The employees discrimination claim was upheld on the grounds that the treatment she had received from her colleagues had been detrimental and that there was a distinction between the treatment which she had received and the treatment received by R. The employer then appealed. The employer submitted that the employment tribunal had erred in finding unfair dismissal based on the alleged flaws in its grievance procedure. They argued that:- The tribunal had failed to consider whether the grievance procedure was within the range of reasonable responses available to the employer. The tribunal had been wrong to confine their considerations to the question of whether or not the employee had received different treatment; and The tribunal should have considered whether or not the employee had received less favourable treatment. The appeal was allowed. It was held that the tribunal had erred by failing to consider whether the employer’s conduct had fallen within the range of reasonable responses available to it when investigating the employee’s complaints. The tribunal had based its decision upon flaws found in the initial stage of the grievance procedure and despite the fact that these flaws had been corrected as the investigation went on, it had still erroneously found that the employer had unfairly dismissed the employee. In addition to this, the evidence before the tribunal, including evidence that R had suffered similar treatment to that complained of by the employee, showed that the relationship between the employee and the two offending colleagues had broken down, and so the behaviour was not related to her OCD. In those circumstances, the tribunal should not have allowed the employees disability discrimination claim. Therefore the employees claims were dismissed. By Janette Blackwell Where are the dogs of yesteryear? They all seem to be some breed or another these days. They never used to be. Back in the forties, we had dogs that LEANED in one direction or another. Or maybe two or three directions at once. But we never went out and bought a specific brand of dog. Why would you buy a dog when the neighbors were giving away perfectly good pups for free, along with a jar of peaches and maybe some string beans? It has always been hard to earn a living farming, and the animals on our Montana farm all had to have a use. The cats earned their living by catching the mice that ate the grain. The dogs earned their living, Daddy told us kids, by bringing in the cows at milking time. Our dogs tended not to be real good at bringing in the cows, but we kept them anyway. Maybe because Daddy had a soft heart — which he did — but mainly, I think, because the dogs had a better understanding of what they were there for than we children did: The dogs thought they were there to bark at every single car that went by. Back when one or two cars came by in a day, we were glad to know that someone was coming down our hill, and, unless it was time for the mailman, we checked to see whose car it was. The forties went by, then the fifties, and the number of cars increased. We no longer checked to see who it was. Which was not the fault of the dogs: they still barked at every single car. By the sixties, I had left home but came back for vacations. And during one summer vacation I found out why we really needed that dog. Theres someone hiding in our shack, said Daddy. Whatever you do, dont go up there. Dont even go near it. The shack, which probably was built as a homesteaders shack, was at the top of the hill by our house. It had one main room with a table and chairs, a cupboard with a few dishes, a wood stove, and a double bed. An outdoor toilet out back beckoned with open door. In the forties and fifties, Grandma cleaned the shack each June. She washed the dishes in the cupboard, washed all the patchwork quilts on the beds, and put fresh kerosene in the lamp. All to prepare for the workers who came to hoe our sugar beets, under a contract between the Mexican government and the sugar beet company. Under that contract a good worker could make fifty dollars a day: excellent wages in the forties and fifties. By the late sixties, Daddy no longer grew sugar beets, and the shack had for years lain empty. Then our neighbor Nina Davis telephoned. Have you got someone in your shack across the road from us? she asked. Because were seeing a light in there at night. No. No ones supposed to be in there, said Mamma. But neither our family nor the Davises went to the shack to investigate, nor did anyone suggest calling the sheriff. The Davises were also native Montanans who went by the same code of behavior we did. Id learned about this code when I was little: one of our neighbors had a practice of stealing from other neighbors. Why dont we tell the sheriff? I asked. If he got arrested, he might or might not get convicted. And if he got convicted, hed get maybe six months in jail, said Mamma. And when he got out of jail, hed come back to our neighborhood to live. And one night our barn would burn down. Or maybe our house. Or someone would shoot our cows or maybe even us. Something. So we leave that situation alone. Now that the rest of the country has discovered Montana and taken over a good chunk of it (the goodest chunk, in fact), people no longer think that way. The Bitterroot Valley has five times the population it had in my childhood. The sheriff has deputies, and according to the local newspaper they are busy day and night responding to complaints of barking dogs, domestic violence, and petty theft. But, during that week in the late sixties, we and the Davises kept watch on the shack and did what we had been taught to do: nothing. Look! said Daddy, as our car drove slowly by one night. We looked, and, sure enough, a dim, grey light shone through the shacks window, which window was pretty dirty now that Grandma no longer gave it her attention. Hes lit the kerosene lamp. Must be reading in there, said Mamma softly. That week we locked the doors of our house every night — something we had never done before — and Daddy slept with his pistol close at hand. In case the dog barked in the middle of the night. So that was why wed put up with all that barking all those years, I realized. That and our familys soft hearts and, where some of those dogs were concerned, our soft heads as well. The Davises tell me they havent seen a light in that shack for three nights, Daddy said a few days later. Im going up with my pistol and investigate. He went up at noonday, stood like a Western lawman with his back to one side of the door, gun ready. He suddenly whirled to face the shack and kicked the door open. Silence. He went inside, gun still at the ready. But the shack was empty. Our fugitive had fugited, leaving behind only a couple of well worn detective magazines and a pile of cigarette butts. And an unmade bed. Sure proof he hadnt been brought up right, you bet. And, in case you wonder, Daddy didnt take the dog when he reconnoitered around the shack that day. Daddy was pretty fond of that little dog, and he didnt want him to get hurt. By Linda Dipman Looking at the complexities of our world is to be totally amazed. From the way our world is balanced with just the right amount of natural wonders to the array of wildlife and the positioning of each and every country in our expansive world. The stars and the moon light up our planet at night and the sun brings rays of light into our day. Every part of our world is miraculous and wonderfully made. The most incredible part of our world is the people themselves. It is awesome to think how we are formed in our mothers wombs. But most of all it’s a mystery on how we even begin to come to know about God. God is our creator. God formed us for a purpose. God made us different by appointing us to live in different countries, cultures, lifestyles and a wide variety of families. Twenty years ago God singled me out. He began by teaching me to be humble. The way He humbled me was to make me gay. You see I was a Bible believing Southern Baptist. To be gay was the ‘kiss of death’ at least to the church I was serving. Very quickly I understood what being humble was all about when my family, church, and even my community turned against me. My children were taken from me. I was jailed, assaulted, and denied justice in the courts. My own father wanted to kill me. All because I was in love with a woman. God said I would not be able to go through the persecution I would face if He didn’t reveal Himself to me in a big way. This is when the supernatural messages began. I no longer had the freedom to worship God in the church because I was not excepted the way I was made by God. So God became my only friend. He ended every message that He gave me with these words, “My Ways are not Human Ways, Trust In Me.” From that moment on God began to reveal to me a different world. A truth that was hidden deep within the psyche of the brain. A Spiritual realm of decision. A battle that pitted evil against good. God did not unfold the wonders of His way to me all at once because like all human beings I was blind to the truth about our world. He did it little by little. Encouraging me to listen to the voice that led me down the path of love. It seemed that love was the key to knowing the will of God. Love identifies God’s truth and reveals the evil plans of man. God made this world as a testing ground. A place where we would learn to choose the right over the bad. So in order for me to understand God’s messages to me, I had to see our world for what it was. Up until the time I was called, I was living the ideal Christian life. I obeyed every law including the speed limit, but when I was persecuted for love, my perception of this world changed. God is love and He reveals Himself to people in love. To throw out our family members and friends because they love differently has nothing to do with God. It is man made up rules and doctrines handed down by the church forefathers. Look at our world and all of the different cultures and belief systems. All governments are set up by people. From democracy to communism to the different ways we believe in God. Laws govern people and tell them how to live and what they are allowed to do. It should be no secret that laws have come in and corrupted the way the church handles faith. This is the very reason why I believe in miracles. God does not need established churches to teach people about Him. All God needs is for us to listen to His voice within our being. All God needs is love to identify Himself to us. Love is not a law, but a feeling. Love supersedes all human ways of thinking. Love is God’s message to people. If we love then we follow God. Think about what spurs you on to giving at Christmas time. We love to give presents to those we love because it make us feel good. To know God is to believe in the miracle of life. To believe in more than just the seen. To understand beyond the limits of this world and see the awesomeness. God’s messages to me helped me to see that our lives have a purpose that goes far beyond the limits of this world. But God also explained to me that I needed to tell people that love is the path to Him. Please help me to get this message out.
